한신대학교의 우즈베키스탄 어학연수생 ‘강제 출국’을 규탄한다!

11월 27일 한신대학교가 한국어학당에 다니던 우즈베키스탄 출신 유학생 22명을 ‘강제 출국’ 시킨 사실이 언론 보도로 드러났다.

한신대 당국은 출입국 사무소에 외국인등록증을 받으러 간다고 학생들을 속여 인천공항으로 향했다. 학생들은 짐조차 챙기지 못한 채 강제 귀국을 당했다. 그런데도 학교 당국은 ‘본인 동의로 출국했음’을 인정하는 서약서에 서명해야 남은 등록금을 환불하겠다며 협박하고 있다.

학교 당국은 당시 이렇게 협박했다. “여러분이 평택 출입국사무소에 가면 감옥에 가야 돼요. 그래서 … [일단 귀국하고] … 3개월 후에 통장 잔고를 채워서 다시 들어와야 돼요.”

한신대 당국이 납치 수준의 반인권 범죄를 저지른 이유에는 법무부의 어학연수생 유학 경비 잔고 증명 기준이 있다. 어학연수생의 경우, 총 1천만 원의 잔고를 3개월 간 유지해야 한다는 것이다. 대학들이 돈을 벌려고 외국인 유학생을 대거 유치하면서도 대체로 가난한 나라에서 온 유학생들에 대한 단속은 강화하겠다는 것이다.

또한 교육부가 매년 교육국제화역량 인증대학(IEQAS)을 선정하는 기준도 문제다. 여기에 선정된 대학은 유학생들의 비자 발급 절차가 간소화되고, 주당 아르바이트 허용 시간도 더 길어진다. 유학생 유치에 유리해지는 것이다. 그런데 교육국제화역량 인증대학(IEQAS) 선정 기준에서 가장 중요한 항목이 바로 기존 유학생들의 ‘불법체류율’이다. 불법체류율이 높으면 ‘비자 발급 제한 대학’에 선정돼 유학생 유치에 장애물이 생긴다. 그러면 대학 당국의 중요한 수입원 하나가 줄어든다.

이 때문에 많은 대학 당국이 이 ‘불법체류율’을 낮게 유지하는 데에 목을 맨다. 그 과정에서 이번처럼 반인권적 범죄 행위가 벌어진다. 가령, 지난해 5월, 전주의 한 대학은 잠적한 어학연수생을 사람을 시켜 붙잡아 온 뒤 감시 인원과 함께 가두고, 휴대전화와 외국인 등록증을 압수하는 짓을 벌였다.

한신대 당국의 만행 이유도 다르지 않다. 한신대학교는 2021년까지 교육국제화역량 인증대학(IEQAS)에 선정됐다가 2022년에 어학연수 과정이, 2023년에 학위 과정이 유학생 모집제한 권고대학(비자발급 제한대학)으로 하향됐다. 어학연수생은 2021년 86명에서 2022년 20명으로 감소했다.

그러나 가난한 유학생들을 감시·통제하고 잠재적 범죄자 취급하는 것이 교육 국제화 역량인가? 심지어 비자 만료도 되지 않은 학생들을 협박해 한국에서 쫓아내며 꿈을 짓밟는 일이 ‘교육’과 무슨 상관이 있는가?

유학생 유치를 돈벌이 수단으로만 여기고 한국의 법과 언어에 익숙하지 않은 유학생들을 협박해 ‘강제출국’ 시킨 한신대학교 당국을 규탄한다. 법무부와 교육부의 차별적 유학생 통제 기준을 규탄한다.

We condemn the ‘forced departure’ of Uzbek language students from Hanshin University!

On 27 November, media reports revealed that Hanshin University had ‘forced’ 22 international students from Uzbekistan to leave the country while attending a Korean language institute of the institution.

After deceiving the students into believing that they were going to the immigration office to get their foreigner’s registration cards, Hanshin University authorities drove them to Incheon Airport, where they were forced to return home without their luggage in the dorm. Nevertheless, the school authorities threatened to refund the remaining tuition fees if they signed an affidavit acknowledging that they had left the country with their own consent.

“If you go to the Pyeongtaek immigration office, you will have to go to jail, so … [once you return] … you will have to come back after three months with the balance in your bank account,” the school authorities threatened.

The reason why the authorities at Hanshin University committed a inhumaine crime like a ‘kidnapping’ is due to the Ministry of Justice’s criteria for proving the balance of language students’ study expenses. Students are required to maintain a total balance of 10 million won for three months. While universities are attracting foreign students in large numbers to make money, they are cracking down on international students, who are mostly from poor countries.

Another issue is the criteria by which the Ministry of Education selects the International Education Quality Assurance System (IEQAS) every year. These universities have a simplified visa process for international students and students are allowed to work more hours per week. This makes them more attractive to international students. However, the most important item in the IEQAS selection criteria is the “illegal immigration rate” of existing international students. A high rate of “illegal immigration” can result in a university being listed as a ‘visa restricted university’, which is a barrier to attracting international students and reduces one of the most important sources of revenue for the university.

For this reason, many university authorities are desperate to keep this rate low. In the process, criminal acts against human rights are committed. For example, in May of last year, a university in Jeonju hired people to capture an undocumented language students, locked them up with surveillance personnel, and confiscated their mobile phone and foreigner’s registration card.

The authorities at Hanshin University are no different. Hanshin University was designated as an International Education Quality Assurance School (IEQAS) until 2021, then it was downgraded to a Recommended University for Restricted Recruitment of International Students in 2022 for language programmes and in 2023 for degree programmes. The number of language students dropped from 86 in 2021 to 20 in 2022.

However, monitoring and controlling poor international students and treating them as potential criminals is nothing to do with “International Education Quality.” What does it have to do with ‘education’ to threaten students whose visas haven’t even expired and kick them out of Korea, crushing their dreams?

We condemn the authorities of Hanshin University for treating international student recruitment as a way to make money and for threatening international students who are unfamiliar with Korean laws and language to “force” them to leave the country. Condemn the discriminatory standards of the Ministry of Justice and the Ministry of Education for controlling international students.
